The Oklahoma Workers' Compensation Act provides that an An employer MUST

  1. Provide reasonable and necessary medical care
  2. with a physician of the employer's choice
  3. within 7 days of ACTUAL notice of of an injury.

This is important - you need to make it clear (and try to secure proof of the same) that you have asked for medical care and treatment from your employer.  A very common problem in handling Oklahoma Workers' Compensation claims is notice either

  1. that the employer often claims that they either did not know that the employee was hurt bad enough to need treatment (admitting that an event happened but denying that it was severe enough to cause injury) or
  2. that the event even happened (even if there are witnesses)

If the employer fails to provide medical treatment within 7 days of actual knowledge of an injury requiring medical treatment in a workers' compensation claim, then the injured employee may select his/her physician to provide medical treatment at the employer's expense.

  • If this happens, you must keep in mind that an employers frequently deny that an employee ever asked for medical care.  Proof is your friend.

Oklahoma workers' compensation laws provide that while an employee is unable to work, that he/she may be entitled to Temporary Total Disability benefits (wage replacement) or other benefits.
