Temporary financial benefits come in two
basic forms in Oklahoma Workers Compensation Cases
- Temporary Total and Temporary Partial
Temporary Total Disability benefits ("TTD")
If you are unable to work
for your employer due to physician restrictions resulting from your
injuries, you are entitled to TTD benefits.
Your TDD rate is equal to
70% of your "average weekly wages" up to the state's average weekly wage.
($717 per week for
injuries from November 1, 2009 through October 31, 2010)
Your TDD benefits are NOT
taxable, but can still be seized to satisfy certain debts such as child
support.
TERMINATING TTD
While an ,
most insurance carriers will wait to do so until you are receive a release
from their chosen treating physician to do so.
However, if you have a claim
filed, you have statutory protections limiting the termination of your TTD
checks. Filing a claim definitely has its benefits to a claimant.
Temporary
Partial Disability benefits ("TPD")
When you are not TTD because
you are working, you may be entitled to
TPD benefits. TPD is designed to
bring your wages up to the TTD rate where your employment is decreased due
to your rehabilitation period. If you are missing work for doctor's
appointments or physical therapy, you need to look to see if you can get
this benefit.
